Express Entry To Canada

The Express Entry System is an online application process that is created to pick and select skilled workers from foreign countries that are applying through one of the federal economic programs for immigration purposes. The Express Entry has been allowing employers to find skilled foreign workers by assessing their skills and experiences through a profile and a point based system called the Comprehensive Ranking System (CRS).

REQUIREMENTS UPON REQUEST

The Express Entry category is divided into two stages.

Step 1 – Candidates Complete Online Profile

You will need to complete an online Express Entry profile. This is basically a questionnaire that will ask for information pertaining to your:

  • Skills;
  • Work Experience;
  • Language Ability;
  • Education, etc.

If you meet the eligibility requirements, your application will be placed in a database of other candidates and will be ranked accordingly based on these qualifications. Only those who:

  • Rank the highest; and
  • Have qualifying offers of arranged employment; or
  • Provincial/Territorial Nominations; will be selected by Citizenship and Immigration Canada.

If you do not already have a job offer or Provincial/Territorial Nomination, you must register with the Government of Canada’s Job Bank which will direct you to eligible Canadian employers. If necessary, employers will need to obtain a Labour Market Impact Assessment from Employment and Social Development Canada. However, they will be exempt from the $1000.00 government processing fee for permanent residence applications under the Express Entry system.

NOTE: Please note that just because you complete an online profile does not mean that you are guaranteed an invitation for permanent residence in Canada.

STEP 2 – Citizenship And Immigration Canada Invites Candidate To Apply For Permanent Residence

Once you have completed your online profile and if you rank among the top in your pool according to your skills and experience, you will receive an invitation to apply for permanent residence in Canada.

Those who have been offered a valid job offer from a Canadian employer or Provincial or Territorial Nomination will be given high scores in the ranking system.

Once you have been invited to apply for permanent residence, you will have sixty (60) days to submit your electronic application under one of the following programs:

  • Federal Skilled Worker Program (FSWP);
  • Federal Skilled Trades Program (FSTP);
  • Canadian Experience Class (CEC); or,
  • A portion of the Provincial Nominee Program (PNP)

Family Class Sponsorship

REQUIREMENTS UPON REQUEST

A) Spousal Sponsorship

If you are a Permanent Resident of Canada or a Canadian citizen, you are eligible to sponsor your spouse to Canada. You will need to provide proof of authenticity and how genuine the relationship is, along with all the requisite documentation. You can file both, an inland or overseas spousal sponsorship application. Depending on your circumstances, you should make the choice of which option to go for.

Responsibilities for Sponsor and Applicant

For all sponsorship applications, sponsors must:

  • Make sure that they meet sponsorship criteria and eligibility requirements and are sponsoring a relative that is a member of the spouse or common-law partner in Canada class.
  • Complete the undertaking and the sponsorship agreement,
  • Include bank or HPM receipt for payment of all applicable fees
  • State whether the application should be discontinued if sponsorship requirements are not met,
  • Submit correctly completed and signed sponsorship and permanent residence application forms, with all required schedules and all required supporting documents to the CPC-V.

B) Parents And Grandparents

As a Canadian citizen or a permanent resident that is at least 18 years old, you can sponsor certain relatives to come to Canada. If approved, they can live, study and work once they become permanent residents.

A parental sponsor has many responsibilities that you should be concerned about. You must ensure that when sponsoring a parent or grandparent, you can support them financially so that they do not seek social assistance from the government.

Responsibilities for Sponsor and Applicant

  • You and the sponsored relative need to sign a sponsorship agreement that requires you to provide any financial support for your relative if necessary, and
  • You must provide financial support for the relatives for a period of 3-10 years, depending on their age and relationship with you.

Financial Requirements

There is a major financial requirement for those who are to sponsor a person to come into Canada. The income of the sponsor for the 12 months prior to the time of application must meet the low-income cut-off amount (LICO) used by Canada Immigration. These numbers are used to determine whether someone is eligible to sponsor a person and take care of them financially. LICO has revised annually.

Economic Class

REQUIREMENTS UPON REQUEST

A) Canadian Experience Class

The Canadian Experience Class (CEC) is one of the pathways to Permanent Residence. You must apply through the Express Entry System to be a candidate for the CEC. Top ranking candidates are chosen in the Express Entry pool and are given an invitation to apply for Permanent Residence. In order to apply, you must meet the minimum requirements, have Skilled Work Experience, and meet the language ability requirements.

Minimum Requirements
You must meet the following:

  • You must be admissible to Canada and there should be no inadmissibility
  • Have a minimum of 12 months full-time Experience or an equal amount in part-time skilled work experience in Canada three years before you apply,
  • You must have gained experience in Canada with proper authorization and law.
  • You must meet the required language levels required for your job
  • You must plan to reside outside of Quebec.

Note: Any work experience gained while you were self-employed and/or a full-time student does not count.

B) Provincial Nominee Program

Most provinces in Canada have entered into agreements when the federal government that allows them to “nominate” applicants of their choosing to facilitate their permanent residence in Canada.

ALBERTA IMMIGRANT NOMINEE PROGRAM

The Alberta Immigrant Nominee Program (AINP) is designed to target immigrants who are ready to support Alberta’s economic growth. There are many streams to this program. Each stream is unique and has different criteria. Determining which is best for you will be the first step to deciding whether or not Alberta is the right province for you.

BRITISH COLUMBIA PROVINCIAL NOMINEE PROGRAM

The BC Provincial Nominee Program (BCPNP) is an economic-based immigration program that seeks to assist the province in maintaining its labor market needs. The program attracts qualified foreign workers who have the proven skills, education and experience to contribute to B.C.’s growing economy.

MANITOBA PROVINCIAL NOMINEE PROGRAM

The Manitoba Provincial Nominee Program (MPNP) facilitates skilled foreign workers and their families to move to Manitoba. Foreign workers currently working in Manitoba or those overseas can qualify based on the two respective streams this province offers: the “Currently Working in Manitoba” Stream and the “Skilled Workers Overseas” Stream.

NEW BRUNSWICK PROVINCIAL NOMINEE PROGRAM

The New Brunswick PNP aims to facilitate qualified business people and skilled foreign workers to obtain their status in Canada through successful nomination by the province. As with all other PNP programs, the applicant will need to demonstrate their intentions to reside in their province of nomination.

SASKATCHEWAN IMMIGRANT NOMINEE PROGRAM

The Saskatchewan Immigrant Nominee Program (SINP) can provide a quicker means of entry into Canada. It allows Saskatchewan to nominate applicants who qualify under three various streams: skilled workers, students and entrepreneurs.

NOVA SCOTIA PROVINCIAL NOMINEE PROGRAM

The Nova Scotia Nominee Program (NSNP) is the first step in a two-step application process for a permanent resident visa to Canada. It allows the Government of Nova Scotia to recruit and select immigrants who intend to settle in the province and have the skills, education, and work experience needed to make an immediate contribution to labor market and economic needs.

NEWFOUNDLAND AND LABRADOR

The Newfoundland and Labrador Provincial Nominee Program (NLPNP) offers nominations through three various streams; the skilled worker, international graduate, or immigrant entrepreneur streams respectively. Qualifying applicants may obtain their nomination to reside in this province.

NORTHWEST TERRITORIES

The Northwest Territories Nominee Program is an immigration program operated by the Government of the Northwest Territories through an agreement with Citizenship and Immigration Canada. It allows qualified individuals, business owners and self-employed professionals to obtain permanent residency in a shorter time than the regular process.

ONTARIO

Ontario Provincial Nominee Program is an immigration program through which Ontario nominates individuals based on various streams: employers, foreign workers, investors, students with a job offer, PhD Graduates and Masters Graduates. Those who fall under one of the categories may qualify for nomination in Ontario.

PRINCE EDWARD ISLAND

The Province of Prince Edward Island welcomes newcomers wishing to embrace the opportunities presented by living in Canada’s smallest province. This program nominates individuals who can demonstrate the positive impact they will have on the province. Applicants will be assessed on their skills compared to the province’s priorities.

YUKON

The Yukon PNP was developed to allow the territory to nominate applicants based on industrial and economic priorities and labor market conditions. This territory offers two streams; the Business Stream and the Skilled Worker/Critical Impact Worker Stream.

C) Federal Skilled Trades Program

The Federal Skilled Trade Workers program is one of the Federal government programs approved for Express Entry. This is a program for people who would like to become Permanent Residents based on their qualifications in a skilled trade.

  • You must use the Express Entry system to come to Canada as a Federal Skilled Trade worker.
  • You must meet the eligibility requirements, skilled work experience, education, and language abilities to qualify.

D) Federal Skilled Workers Program

All Skilled Immigrants must use the Express Entry System to come to Canada. This is a system where eligible candidates are placed in a pool with other candidates and are selected based on their rankings. The top candidates receive an Invitation to Apply which makes them eligible to apply online for permanent residence.

There are 3 kinds of Skilled Immigrants that Express entry covers:

  • Federal Skilled Workers
  • Federal Trade Skilled Workers, and

To be eligible for Express Entry, you must meet the requirements for the Federal Immigration Programs above. In order to be eligible for Express Entry you must:

  • Meet the minimum Language Requirements
  • Have skilled work experience, and
  • Register with Job Bank
  • Must meet the level of Canadian Language Benchmark (CLB)7 in English, or
  • Must meet the level of Niveaux de Comptence Linguistique Canadiens (NCLC) 7 in French.

Business Immigration

REQUIREMENTS UPON REQUEST

A) StartUp Visa

A Start-up Visa is focused on attracting foreign entrepreneurs to bring their business ideas to Canada. This revolutionary new visa is the first of its kind and results in the applicant(s) obtaining permanent resident status in Canada. However, before you can apply, you will also need to find the right financial backing in Canada.

In order to be eligible, as the applicant, you must

  • Prove your business venture or idea is supported by a designated organization
  • Meet the language requirements
  • Meet the education requirements
  • Have sufficient settlement funds

B) Investor Program

If you have a high net worth, you may be eligible to apply through the Federal Investment Program. The program allows you to establish your own enterprise and immigrate to Canada. Since you are a potential investor who can add to the economic development of the country, Canada has an interest in you. To be eligible under this category, you must have a minimum of $1.6,000,000 CAD as your net worth. Moreover, you pledge that you will invest at least $800,000 CAD.

  • Citizenship and Immigration Canada oversees your investment. This is indeed one of the most important categories serving the economic development of the country. The invested amount creates new jobs and thus helps the local, as well as, federal economies grow.
  • Once you have signed the agreement, CIC will send you a confirmation, with instructions on how to submit the amount. You are required to deliver the amount within 30 days. After you have paid the amount, you’ll be given permanent residence. The amount invested is only taken by the money to generate other sources of income for local residents. You will receive your investment back in five years. However, you will not receive any kind of interest over the invested amount.
